Claudia Tillery, 46, argues in court papers filed Tuesday that Department of Education officials violated her rights by using sealed investigative files to get her canned.

The files were sealed after a jury acquitted Tillery in April 2014 of providing a student drugs and alcohol and raping him when she was a teacher at MS 35 in Bedford-Stuyvesant. Her suit to get her dismissal overturned is pending.

The city law and education departments had no immediate comment.
